1 General terms and conditions

These provisions cover the terms concerning the ordering, delivery and cancellation of Products that are ordered through Aicci Oy’s (“Aicci”) Aicci.fi online store service (“Service”).

The Service is intended for private individuals (“Customer” or “You”) who live in the European Union countries or Norway.

Product (“Product”) refers to all products sold on aicci.fi online-store.

In addition to these terms and conditions, the sale of Products is governed by the provisions of the Consumer Protection Act.

When ordering Products via the Service, the Customer accepts the terms and agrees to comply with them. In addition, the Service contains communications and practical instructions that complement the terms. Aicci reserves the right to amend these terms and the Service content. By using the Service, the Customer accepts the changes. The most recent version of the terms and conditions will be kept available on Aicci’s website.

 

2 Ordering

The Customer can order Products through the Service either by first registering as a user of the Service or without registration. The Customer is bound by their order once they have placed, accepted and paid for it. The Customer is responsible for the accuracy of the information they supply to Aicci. Aicci is not responsible for damages or disruptions that are caused to the Customer or to a third party because of inaccurate information provided by the Customer.

You must be at least 18 years old to order from Aicci’s online store.

Aicci has the right to delete a Customer’s order, if the Customer is in breach or circumvention of the terms of the Service or acts in contravention of the law or good practice. Aicci reserves the right not to sell Products to the Customer.

The main Product characteristics and prices are indicated on the Product page. An indication of Product availability and possible restrictions on availability is given in the same context.

 

3 Prices

The Product price is the price displayed for the item on the Service at the time of ordering. All prices displayed are inclusive of VAT (Value Added Tax). The Product prices are displayed in EUR. Delivery charges are included in Product prices.

 

4 Methods of payment

The Customer must pay for the ordered Products when placing the order, by using one of the payment methods indicated by Aicci. These payment methods are specified in the Service.

 

5 Product warranty

The guarantee period for products manufactured or sold by Aicci Oy is two (2) years. The guarantee period begins on the date when the product is delivered.

The guarantee covers any factory defects and material defects detected in a product if the product was installed by the related installation instructions and requirements and is being used according to the instructions provided by the manufacturer.

If the customer detects a defect, they must contact Aicci without delay and submit the defective product to Aicci. If the warranty conditions are met, Aicci will repair the product, deliver a new spare part or replace the defective product with a new one free of charge.

The warranty is not valid if:
– The damage or failure is caused by overvoltage, incorrect use, natural forces (e.g. thunderstorm or lightning), water damage, fire or another surprising or unexpected circumstance.
– The product has been modified without written permission and instructions from Aicci.
– The installation includes incompatible devices, such as incompatible control system components or an unsuitable power supply for the lighting fixture.
– The product has been broken mechanically or has been stored inappropriately.

The guarantee does not cover:
– Any costs arising from detecting and repairing the fault or replacing the defective product with a new one.
– Any damage the product may cause to other properties.
– Any faults or reduced lighting power resulting from natural wear and tear. During the guarantee period, the amount of light generated by the lighting fixture is permitted to decrease by no more than 30% from the promised level.

 

6 Delivering Products

Products are delivered within Finland, EU-courtries, Norway and Switzerland. If the delivery area is otherwise restricted, these restrictions will be indicated by the Service.

Delivery time is specified in the Service. Aicci delivers the products to the Customer based on an agreement with a third-party contract of the carriage. Aicci takes responsibility for the loss and damage of the Product occurred during the delivery.

Aicci shall not be liable for delays in performing or failure to perform this Agreement or any obligations hereunder, which are directly attributable to causes beyond its reasonable control (force majeure), including, but not limited to, fires, strikes, labor disputes, war, acts of intervention by any governmental authority, failure of a common carrier, supplier, hardware, software, browser, or communications equipment, or network failure, congestion, or malfunction.

Aicci is not responsible for damage caused by possible disruptions, faults or delays in Product processing or deliveries, arising for reasons unrelated to the Service. Aicci is not responsible for damage caused by the unreasonable impairment of operations due to force majeure or an equivalent reason, such as the actions of a public authority, war or the threat thereof, an insurrection or riot, or disruptions that are beyond Aicci’s control in mail delivery, automatic data processing, data transfer, other electronic communication or electricity supply, as well as disruptions caused by fires or other accidents, or labour disputes, such as strikes, lockouts, boycotts or blockades. In the event of force majeure or other of the above-mentioned circumstances, Aicci has the right to suspend the delivery of orders until further notice.

In the event of delivery problems related to an ordered Product, Aicci will contact the Customer.

 

7 Right to cancel and return Products

The Consumer Protection Act gives Private Customers the right to cancel orders within 14 days (EU 2011/83). The Customer must inform Aicci of the cancellation within 14 days of receiving the Products, in which case the Products must be returned without delay and not later than within 14 days of the cancellation. Simply returning the Products or not collecting them is not enough; the Customer must also notify Aicci of the order cancellation in writing.

The Customer must also provide proof of purchase (order confirmation/receipt) when returning the Products. Customer can return the Products by post. The Products must be packed carefully to prevent damage or breakages. The Customer bears the costs of returning the Products, such as postage and packaging.

In order for the Customer to retain their right to return the Products, they must be materially unchanged and undiminished. Returned Products must be in a sellable condition, and the original packaging must be undamaged and complete. Opened Products cannot be returned. The Customer must return the Products in their original packaging. The transport packaging can be opened.

Appropriately returned Products will be refunded to the Customer within 14 days of the Customer having notified Aicci of the cancellation of the order and having returned the Products to Aicci. If the Customer returns only some of the Products, the delivery costs will not be refunded. Refunds will be made using the same method of payment that the Customer used when placing the order.


Special notes
Exceptions from the right of withdrawal as regards the supply of goods made to the consumer’s specifications or clearly personalised. Aicci’s products that are custom made or otherwise customized are not eligible for a refund. All Aicci T1 tables are made by Aicci to the consumer’s specifications.

 

8 Notification of faults and limitation of liability

Aicci is liable for any faults found in the Products or their delivery as per the Consumer Protection Act.

The Customer must notify Aicci of any faults found in the Products within a reasonable time, but no later than within 2 months, in order to allow Aicci to rectify the fault or to otherwise compensate the Customer.

Aicci must be notified of any faults in writing. Notifications of faults can be submitted by email to info@aicci.fi.

In the event of a defect in the Product, we will always seek to repair or replace the Product first and foremost before we provide monetary compensation.

Unless otherwise stipulated in the mandatory provisions of the Consumer Protection Act, Aicci cannot be held liable for any indirect loss incurred by the Customer, and Aicci’s liability for any direct loss incurred by the Customer for breach of contract will be limited to the total value of the Products ordered.

 

9 Processing of personal data and cookies

Any personal data provided by the Customer, either electronically or otherwise, will be processed in accordance with the General Data Protection Regulation (EU 2016/679) and Finnish national legislation.

The Customer’s data is gathered and stored in Aicci’s customer database. How Aicci uses personal data and cookies is described in Aicci’s privacy policy on Aicci’s website.

 

10 Disagreements

Finnish law applies to these order and delivery terms, excluding connecting factor rules.

All disagreements arising from and related to these terms of order and delivery should be settled through negotiations between Aicci and the Customer in the first instance. In the event of a defect in the Product, we will always seek to repair or replace the Product first and foremost before we provide monetary compensation.

Private Customers always have the right to take disputes arising from these terms and conditions to the Consumer Disputes Board (in Finland www.kuluttajariita.fi).  The European Consumer Centres Network (ECC-Net) advices consumers in the other EU Member States, plus Norway, Iceland, and the UK. Private Customers may also seek a resolution to a dispute via the Online Dispute Resolution (ODR) forum (https://ec.europa.eu/odr). Using the ODR forum requires Aicci’s email address, which is info@aicci.fi.

1 General terms and conditions

These provisions cover the terms concerning the ordering, delivery and cancellation of Products that are ordered through Aicci Oy’s (“Aicci”) Aicci.fi online store service (“Service”).

Product (“Product”) refers to all products sold via the aicci.fi online store service.

Customer refers to a legal person that orders Products as an Aicci business customer (Customer) and is based in the European Union countries or Norway. A Customer must have a valid Business ID and enter it into the Service when they sign up.

When ordering Products via the Service, the Customer accepts the terms and agrees to comply with them. In addition, the Service contains communications and practical instructions that complement the terms. Aicci reserves the right to amend these terms and the Service content. By using the Service, the Customer accepts the changes. The most recent version of the terms and conditions will be kept available on Aicci’s website.

 

2 Ordering and delivering products

The Customer must register to make orders. A binding contract of sale is made when the Customer has paid for the order and Aicci has sent the Customer an order confirmation confirming the availability and delivery time of the Product. The Customer is responsible for the accuracy of the information it provides to Aicci. Aicci shall not be liable for any damages or interruptions to the Customer or any third party caused by incorrect information provided by the Customer. Aicci reserves the right not to accept the order.

Aicci is not responsible for damage caused by possible disruptions, faults or delays in Product processing or deliveries, arising from reasons unrelated to the Service. Aicci is not responsible for damage caused by the unreasonable impairment of operations due to force majeure or an equivalent reason, such as the actions of a public authority, war or the threat thereof, an insurrection or riot, or disruptions that are beyond Aicci’s control in mail delivery, automatic data processing, data transfer, other electronic communication or electricity supply, as well as disruptions caused by fires or other accidents, or labour disputes, such as strikes, lockouts, boycotts or blockades. In the event of force majeure or other of the above-mentioned circumstances, Aicci has the right to suspend the delivery of orders until further notice.

The product price is the price displayed for the item on the Service at the time of ordering. All prices displayed are inclusive of VAT (Value Added Tax). The product prices are displayed in EUR. Delivery charges are included in the product prices.

In the event of delivery problems related to an ordered Product, Aicci will contact the Customer.

Products that have been ordered and paid for are non-returnable.

Aicci has the right to charge a processing fee, which covers the costs incurred the delivery, return and other expenses for orders that have not been received or handed over during transport.

 

3 Methods of payment

The Customer must pay for the ordered Products when placing the order, by using one of the payment methods indicated by Aicci. These payment methods are specified in the Service.

Customers can also pay for their orders by pro forma invoice under separate terms and conditions.

 

4 Product warranty

The guarantee period for products manufactured by Aicci Oy is three (3) years. The guarantee period for other products is two (2) years. The guarantee period begins on the date when the product is delivered.

The guarantee covers any factory defects and material defects detected in a product if the product was installed by the related installation instructions and requirements and is being used according to the instructions provided by the manufacturer.

If the customer detects a defect, they must contact Aicci without delay and submit the defective product to Aicci. If the warranty conditions are met, Aicci will repair the product, deliver a new spare part or replace the defective product with a new one free of charge.

5 Cancellation of orders

If a Customer cancels an order, or part of an order, after the date of the order confirmation, we will charge the client following the order confirmation.

 

6 Notification of faults and limitation of liability

If there is a fault in the Product or the delivery, the Customer should notify Aicci of it without delay after receiving the Product, and deliver the faulty Product to Aicci. When notifying Aicci of a fault, the Customer must present the order confirmation/receipt for the order made. Aicci will repair or replace the faulty Product or provide other compensation.

Aicci must be notified of any faults in writing. Only written notifications of faults will be processed. Notifications of faults can be submitted by email to info@aicci.fi or by post to Aicci Oy, Punasillantie 33, FI-40950 Muurame, FINLAND.

Aicci cannot be held liable for any indirect losses incurred by the Customer, and Aicci’s liability for any direct losses incurred by the Customer for breach of contract will be limited to the total value of the Products ordered.

 

7 Processing of personal data and cookies

Any personal data provided by the Customer, either electronically or otherwise, will be processed according to the General Data Protection Regulation (EU 2016/679) and Finnish national legislation.

The Customer’s data is gathered and stored in Aicci’s customer database. How Aicci uses personal data and cookies is described in Aicci’s privacy policy on Aicci’s website.

 

8 Applicable law and settlement of disputes

Finnish law applies to these order and delivery terms, excluding connecting factor rules.

All disagreements arising from and related to these terms of order and delivery should be settled through negotiations between Aicci and the Customer in the first instance. If negotiations fail to reach a conciliatory outcome, the disagreements shall be settled in the District Court of Jyväskylä, Finland.
